3) Eligibility (17+)
You must be at least 17 years old to use the Services. By using the Services, you represent that you meet this requirement and have the legal capacity to enter into these Terms.
4) Accounts
- Provide accurate information and keep it up to date.
- Maintain the confidentiality of your credentials.
- Notify us promptly if you suspect unauthorized access.
You are responsible for activities that occur under your account to the extent permitted by law.
5) License & Acceptable Use
License
Subject to your compliance with these Terms, Askira grants you a limited, non-exclusive, non-transferable, revocable license to install and use the App for your personal, non-commercial use.
Acceptable use
- Do not use the Services for unlawful purposes or in violation of applicable laws.
- Do not reverse engineer, decompile, or attempt to extract source code except where permitted by law.
- Do not interfere with the Services or circumvent security features.
- Do not upload or transmit malware or harmful code.
- Do not misuse optional upload or processing features; only upload content you have rights to use.
6) Your Content
You may be able to submit or store content in the Services, such as fragrance logs, notes, photos, and support messages ("User Content").
Ownership
You retain your rights to your User Content. You are responsible for your User Content and for ensuring you have the necessary rights to submit it.
Permission to operate the Services
You grant Askira a limited license to host, store, reproduce, and process your User Content only as necessary to provide and operate the Services and features you enable. This license ends when your User Content is deleted, subject to backup and retention practices described in our privacy practices.
7) Photos & Optional Processing Features
- We do not perform face recognition and we do not use images to infer biometric identifiers.
- We do not create or store biometric templates.
- If an optional processing feature is used, it is performed once to produce the requested output and related inputs are deleted promptly after processing.
- We do not use photos for advertising/marketing and we do not use them to train third-party models.
8) Privacy
Our Privacy Policy explains how we collect and use information. By using the Services, you also consent to our privacy practices as described in our Privacy Policy.
9) Third-Party Services
The Services may rely on or interact with third-party services (for example, operating system features). We are not responsible for third-party services and your use of them is governed by their terms and policies.
10) Disclaimer of Warranties
To the maximum extent permitted by law, the Services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express, implied, or statutory.
11) Limitation of Liability
To the maximum extent permitted by law, Askira will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, goodwill, or other intangible losses arising out of or related to your use of the Services.
To the extent permitted by law, Askira's total liability for all claims relating to the Services will not exceed the amount you paid to Askira for the Services in the 12 months before the event giving rise to the claim (or, if you paid nothing, a nominal amount).
12) Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Askira from and against claims and expenses arising out of or related to your use of the Services or violation of these Terms or applicable law.
13) Termination
You may stop using the Services at any time. We may suspend or terminate access if we reasonably believe you violated these Terms, or to protect the Services, users, or comply with law.
Upon termination, your license to use the App ends. Sections that by their nature should survive will survive.
14) Changes
We may modify the Services or these Terms from time to time. We will update the "Last Updated" date at the top of this page. Continued use after changes become effective means you agree to the updated Terms to the extent permitted by law.
15) Governing Law & Binding Arbitration
These Terms are governed by the laws of Askira Team's principal place of business, without regard to conflict of law rules.
Unless prohibited by law, disputes arising out of or relating to these Terms or the Services will be resolved by binding arbitration. Before initiating arbitration, you agree to contact us at rgclepuegb6299@outlook.com and attempt informal resolution.
16) Apple App Store Additional Terms (iOS)
- Acknowledgement: these Terms are between you and Askira, not Apple. Apple is not responsible for the App or its content.
- Scope of license: the license is limited to use on Apple-branded products you own or control and as permitted by App Store terms.
- Maintenance and support: Askira is responsible for support (if any). Apple has no support obligation.
- Product claims: Askira is responsible for claims relating to the App (including product liability, legal/regulatory compliance, and consumer protection claims).
- Intellectual property: Askira will handle IP infringement claims as required by these Terms.
- Legal compliance: you represent you are not located in an embargoed country and are not on restricted/prohibited lists.
- Third-party beneficiary: Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
